How long do I have to file a personal injury claim?

In most cases, you have 3* years from the date of the accident or medical negligence to file a personal injury claim. However, there are exceptions:

- If the claim is against a state organisation (eg. Government school or hospital) you may need to give notice within 6 months.

- If the injured person is a minor or mentally incapacitated, different time limits may apply.

It’s always best to start the process as soon as possible - deadlines can be tricky, and missing one could mean losing your right to claim.
